1. Acceptance of Terms

By accessing and using AperturePM, you accept and agree to be bound by the terms and provisions of this agreement. You must be at least 18 years old to use this application. If you do not agree to these Terms, you must not access or use AperturePM.

2. Description of Service

AperturePM ("Aperture Property Management") is a comprehensive property management web application that enables property managers and tenants to manage leases, process payments, handle maintenance requests, schedule events, manage documents, and facilitate communication. I provide tools for efficient property management and tenant relations.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your account information up to date
• Maintain the security of your password and account
• Immediately notify me of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Acceptable Use Policy

You agree not to use AperturePM to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any harmful, illegal, defamatory, or offensive content
• Interfere with or disrupt the application, servers, or networks
• Attempt to gain unauthorized access to other accounts or systems
• Use AperturePM for any fraudulent or unauthorized commercial purposes
• Upload viruses, malware, or other malicious code
• Harvest or collect information about other users without consent
• Impersonate any person or entity or misrepresent your affiliation

5. Payments and Financial Terms

AperturePM may facilitate rent payments and other financial transactions. You agree that:

• You are responsible for all payments made through your account
• Payment information must be accurate and current
• I may use third-party payment processors for transactions
• Fees and charges will be clearly disclosed before processing
• Refunds will be handled according to my refund policy

6. Privacy and Data Protection

Your privacy is important to me. Please review my Privacy Policy, which governs the collection, use, and protection of your personal information and is incorporated into these Terms by reference.

7. Intellectual Property

AperturePM and its original content, features, and functionality are owned by me and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on AperturePM without my express written permission.

8. Service Availability and Modifications

I strive to provide reliable service but cannot guarantee uninterrupted availability. I reserve the right to modify, suspend, or discontinue any aspect of AperturePM at any time, with or without notice. I will make reasonable efforts to notify users of significant changes that may affect their use.

9. Disclaimers and Warranties

AperturePM is provided "as is" and "as available" without warranties of any kind, either express or implied. I disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that AperturePM will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, whether incurred directly or indirectly, or any damages resulting from your use of or inability to use AperturePM.

11. Indemnification

You agree to indemnify, defend, and hold me harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from your use of AperturePM, violation of these Terms, or infringement of any rights of another party.

12. Termination

I may terminate or suspend your account and access to AperturePM immediately, without prior notice, for conduct that I believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may also terminate your account at any time by contacting me.

13. Changes to Terms

I reserve the right to modify these Terms at any time. I will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, I may provide additional notice. Your continued use of AperturePM after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms will be resolved through binding arbitration or in the courts of competent jurisdiction, as appropriate under applicable law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
